      <title>New WEEE Regulations and Guidance Notes</title>

        <p>The Government has amended the <a href="http://www.opsi.gov.uk/si/si2007/pdf/uksi_20073454_en.pdf" class="external" target="_blank" title="Go to the BERR WEEE Regulations website in a new browser window">WEEE Regulations</a> in an attempt to improve the way the Producer Responsibility system works for waste electrical and electronic equipment.
</p>
<p>
The changes are relatively minor and were laid before parliament on Wednesday this week with five main areas having been altered:
</p>
<ul><li>A tightening of the system of issuing evidence of WEEE re-use;</li><li>A change to require evidence to be issued to the nearest kilogramme, rather than the nearest tonne;</li><li>A right for final holders of household WEEE (such as repair companies) to hand the equipment into a collection point free-of-charge;</li><li>The extension of the February deadline to April for submitting the previous year&#8217;s compliance evidence;</li><li>An additional regulation allowing the Secretary of State to publish the acceptable format for records used by distributors</li></ul>
<p>
The changes to The UK WEEE Regulations will come into effect on January 1st 2008 which marks the second compliance period within the WEEE producer responsibility system.
</p>
<p>
BERR also an updated <a href="http://www.berr.gov.uk/files/file42909.pdf" class="external" target="_blank" title="Go to the BERR Guidance Document website in a new browser window">Guidance Notes</a> along with the amended Regulations. The Guidance Notes cover the obligations which the WEEE Regulations place on producers who put electrical and electronic equipment (EEE) onto the UK market, and obligations on distributors of EEE in the UK. They also cover the roles and implications for others including Local Authorities, the waste management industry, the charitable and voluntary sector, and implications for users and consumers of EEE, and others.&nbsp;

        <p>The Environment Agency is targeting producers (importers) of electrical goods in the UK that are yet to register with an approved WEEE compliance scheme.
</p>
<p>
The WEEE Regulations require producers of electronic goods to contribute financially each year towards the UK&#8217;s new collection and recycling network for WEEE.
</p>
<p>
Producers must join a compliance scheme to carry out their obligation, and their recycling fees depend on the amount of goods they sell each year but those that don&#8217;t register face prosecution.
</p>
<p>
Liz Parkes, head of waste at the Environment Agency, said: &#8220;Nearly 4000 producers have signed up for the first compliance period which runs to the end of this year and they&#8217;ll need to renew their registration for next year with any of the compliance schemes available.&#8221; 
</p>
<p>
&#8220;However, we know that there are still some companies out there that need to register for the current year. Our message is simple - join an approved compliance scheme now. Leave it too late and you risk enforcement action from us.&#8221;

        <p>The EU Waste Electrical and Electronic Equipment (WEEE) Directive will soon come into force in the UK. Any producer, importer or distributor of electrical and electronic equipment in the UK has obligations. If you are obligated, you will have to finance the treatment, recovery and disposal of hazardous WEEE from 1st April 2007 and all other WEEE from 1st July 2007. 
</p>

If obligated, you will need to register with an approved compliance scheme to meet your obligations and supply data on how much EEE you place on the market each calendar year. You also need to say whether you supplied the equipment for household or business use. You will get a WEEE producer registration number that you will need to give to anyone who distributes or sells your equipment. You will also need to mark your products with a crossed out wheelie bin from 1st April 2007. <strong>If you fail to comply you will be breaking the law and may be liable to a fine.</strong>

        <p>The Department of Trade and Industry has launched its final consultation on the Waste Electrical and Electronic Equipment directive.
</p>
<p>
This announcement sees the beginning of the final phase of implementing the WEEE directive. The key aspects outlined in the consultation are expected to follow on from the review carried out last December and extensive consultation with key stakeholders since then.
</p>
<p>
The consultation will run from today until October 17 2006 and Comply Direct will ensure the views of all its early bird members are heard. <em><strong>&#8220;</strong>A new packaging compliance service &#8211; aiming to be the &#8220;Easy Jet&#8221; of its field &#8211; has been launched by a partnership of companies in the recycling sector. The Comply Direct service is offering a &#8220;no frills&#8221; service for companies who do not wish to be part of a full compliance scheme to handle their legal packaging recycling obligations.
</p>
<p>
The new scheme, run by the Recycling in Action group of companies, initially focuses on packaging producer responsibility, but once new regulations on waste electronics come into force, plans are to expand into the waste electronics arena.
</p>
<p>
Comply Direct has said it will be targeting its service at &#8220;free riders&#8221; &#8211; packaging producers that are currently avoiding their recycling duties for whatever reason, as well as those producers registered direct with the Agency, handling their obligations outside a compliance scheme.
</p>
<p>
The scheme will also hope to attract those companies that have been members of compliance schemes in the past, and now feel sufficiently knowledgeable on the regulations to comply independently.
</p>
<p>
Spokeswoman Hannah Kendall explained: &#8220;The company offers low cost compliance, but has experts in the field. It is an online service that is easy to use and we will only be charging for services that the customer wants rather than offering an expensive scheme offering lots of services a company may not need. Its like Easy Jet, you still get from A to B, but you will not get the drinks trolley unless you want it,&#8221; she told letsrecycle.com.<strong>&#8220;</strong>

      <title>Delayed&amp;hellip; but not gone away</title>

        <p>Energy minister Malcolm Wicks recently confirmed that the implementation of the WEEE directive is to once again be delayed. There is little indication as to the length of this latest delay other than it is now unlikely that the directive will be transposed into UK regulations before the summer 2006. This will result in producer responsibility commencing from Q1 2007 at the earliest. 
</p>
<p>
Announcing the delay, Mr Wicks said: &#8220;The directive is challenging and effective implementation of its obligations requires a lot of planning and preparation &#8211; it is vital that the producers, retailers and the waste industry together with Government have the appropriate plans, infrastructure and regulations in place.&#8221;
</p>
<p>
One thing that&#8217;s certain with regards to the WEEE directive in the UK is that it will be here eventually. Comply Direct will continue to engage with the DTI regarding the latest thinking on implementation to ensure that the final regulations are flexible and fair to ensure costs can be minimised whilst not placing too much of an administrative burden on UK producer obligated companies.
